The Belmont Report’s distinction between research and the practice of accepted therapy has led various authors to suggest that these purportedly distinct activities should be governed by different ethical principles. We consider some of the ethical consequences of attempts to separate the two and conclude that separation fails along ontological, ethical, and epistemological dimensions. Clinical practice and clinical research, as with yin and yang, can be thought of as complementary forces interacting to form a dynamic system in which the whole (...) exceeds the sum of its parts. Just as effective clinical practice cannot exist without clinical research, meaningful clinical research requires the context of clinical practice. We defend this thesis by triangulation, that is, by outlining how multiple investigators have reached this conclusion on the basis of varied theoretical and applied approaches. A two-body quantum correlation is calculated for a particle reflecting from a moving mirror. Correlated interference results when the incident and reflected particle substates and their associated mirror substates overlap. Using the Copenhagen interpretation of measurement, an asynchronous joint probability density, which is a function both of the different positions and different times at which the particle and mirror are measured, is derived assuming that no interaction occurs between each measurement. Measurement of the particle first, in the correlated interference region, (...) results in a splitting of the mirror substate into ones which have and have not reflected the particle. An analog of the interference from the Doppler effect for only measurements of the particle, in this two-body system, is shown to be a consequence of the asynchronous measurement. The simplification obtained for a microscopic particle reflecting from a mesoscopic or macroscopic mirror is used to illustrate asynchronous correlation interferometry. In this case, the small displacement between these mirror states can yield negligible environmental decoherence times. In addition, interference of these mirror states does not vanish in the limit of large mirror mass due to the small momentum exchange in reflecting a microscopic particle. (shrink)

The paper intends to provide an algebraic framework in which subluminal causation can be analysed. The framework merges Belnap's 'outcomes in branching time' with his 'branching space-time' (BST). it is shown that an important structure in BST, called 'family of outcomes of an event', is a boolean algebra. We define next non-stochastic common cause and analyse GHZ-Bell theorems. We prove that there is no common cause that accounts for results of GHZ-Bell experiment but construct common causes for two other quantum (...) mechanical setups. The context of Bild-Anthropologie developed by H. Belting. Works of art are regarded here as images, especially—images of a cultural type. The accent lies here on genealogy of iconoclasm and theological discourse which uses Greek philosophical terminology. Ontology of “image as a presence” is analyzed with regard to magical realism and symbolism. Primordial and prehistoric images do not operate with signs of objects but instead they constitute objects themselves. 3. The context of structural anthropology where the art is interpreted within the horizon of mytho-logics and metaphoric-metonymical transformations. Kmita’s adjustment shows that metaphorical and metonymical meanings are indistinguishable. The art—which was ascribed a classificatory meaning—provided also socio-morphic categories. Totemic signs were more appreciated than totems themselves. It shows that the art transcends the reality which itself becomes a subject of the image. 4. The context of shamanistic origins of art. This conception universalizes results of neuropsychological research. Trance-practices are considered here as the origin of cave painting which presents a scheme of shamanistic visions. However, in folk cultures not all imaginary objects originate from trance-experience and the acceptance of their reality does not presuppose sensory deprivations (which is one of ethnological arguments showing limits of such interpretation). Formalising deontic concepts, such as obligation, prohibition and permission, is normally carried out in a modal logic with a possible world semantics, in which some worlds are better than others. The main focus in these logics is on inferring logical consequences, for example inferring that the obligation O q is a logical consequence of the obligations O p and O. In this paper we propose a non-modal approach in which obligations are preferred ways of satisfying goals expressed in first-order logic. (...) To say that p is obligatory, but may be violated, resulting in a less than ideal situation s, means that the task is to satisfy the goal p ∨ s, and that models in which p is true are preferred to models in which s is true. Whereas, in modal logic, the preference relation between possible worlds is part of the semantics of the logic, in this non-modal approach, the preference relation between first-order models is external to the logic. Although our main focus is on satisfying goals, we also formulate a notion of logical consequence, which is comparable to the notion of logical consequence in modal deontic logic. In this formalisation, an obligation O p is a logical consequence of goals G, when p is true in all best models of G. We show how this non-modal approach to the treatment of deontic concepts deals with problems of contrary-to-duty obligations and normative conflicts, and argue that the approach is useful for many other applications, including abductive explanations, defeasible reasoning, combinatorial optimisation, and reactive systems of the production system variety. By interpreting The Emperor's New Groove through Mencius, it seems clear that it is not always a bad thing that people change their groove. Mencius (...) would no doubt concur that the film serves as a kind of extended thought‐experiment with a moral: It might seem like one has everything, but if he/she has not cultivated his/her inherent goodness properly, he/she has nothing truly worth having. ABSTRACT What are the sources of political myths? Useful starting points for answering this question can be found in the fiction of Cervantes and the political philosophies of Machiavelli, Erasmus, and Leo Strauss. These writers, who sought to defuse clashes of custom and of religion, emphasized the need to pay attention to the consequences of false belief, without lapsing into cynicism. In this, they were the ultimate idealists, whose insights might temper the dogmas of the modern ideologue.

In this article, I would like to take a closer look at the philosophical meaning of the term “process,” which is a fundamental category in Arnold Mindell’s psychology. The Taoist origins of this concept go back to the Tao – the principle of the universe. Tao is the process of passing into each other the opposite aspects of the monastically understood Qi energy. Mindell was also inspired by the analytical psychology of Carl Gustav Jung, which emphasizes the importance of archetypal, (...) unconscious mental processes and their impact on the ego through random thoughts, fantasies or dreams. Mindell distinguishes between a primary process (mental content that we are aware of) and a secondary process (mental content that we are not aware of) to explain what connects a person with her natural living – an unadulterated existence through rigid boundaries between the two processes acquired during one’s upbringing. The purpose of this article is to explore the Jungian and Taoist roots of Mindell’s psychology and to characterize individual lives as confronting their entire processual being, thus becoming natural living. -------------------------- Received: 14/04/2022. This text aims at a multi-dimensional reflection on Erich Fromm’s conception of the human being. Starting from Marxist-Freudian sources of the philosopher’s thought, the authors show the fundamental ideas underlying his version of psychoanalysis. Next, Fromm’s view of the human being as a social being is discussed, referring to the concepts of unproductive and productive orientations. Another important dimension of Fromm’s thought that is discussed is the reflection on the nature and functions of the symbolic language of the unconscious, which (...) reveals to the human being both the best and the worst aspects of his or her personality. One of the most famous concepts of the American philosopher is also discussed — the distinction between the being mode and the having mode. The authors drawattention to the value Fromm placed on a life oriented towards the being mode. Finally, they remind us, following Fromm, that a human being turns towards himself in his or her dreams, going beyond all the schemes and concepts that bind his mind when he or she is awake. The understanding of oneself that comes from a deep reflection on the content and character of a dream can awaken in a person the recognition of previously unknown dimensions of his or her mind; from now on, he is not merely someone immersed in the reality of everyday life. Crossing the horizon of oneiric imagination, he or she becomes free, in the dream, and she experiences the freedom of being on waking. (shrink)

The Alberta tar sands, and the proposed pipelines which would carry their bitumen to international markets, comprise one of the most visible environmental controversies of the early twenty-first century. Jacques Ellul’s theory of technology presents ostensibly physical phenomena, such as the tar sands, as social phenomena wherein all values are subsumed under the efficient mastery of nature. The effect of technological rationality is totalizing because technical means establish themselves as the exclusive facts of the matter, which creates a socio-political environment (...) wherein ethical engagement is precluded. Analyzing the tar sands controversy through Ellul’s hermeneutic challenges environmental ethics to a more radical stance than the continuation of the technological worldview, and thus offers meaningful and hopeful alternatives to the status quo. It is perhaps most useful to approach the Doctor-Patient relationship (DPR) by admitting that it’s complicated. We review some of the strategies that have been employed to mitigate this complexity, zeroing in on one that promises to capture the main features of the DPR without eliminating some of its more important, existential components; pieces of the puzzle that must be retained if we are to avoid oversimplification and the errors that can arise by ignoring important foundational properties. We believe that (...) a useful way to look at the DPR and to capture essential features that must be balanced in the process is provided by Partnership Theory and its definition in terms of the so-called domination and partnership systems. We apply this theory to the DPR and investigate the implications of this application to health care. We see that in the absence of mitigating circumstances, adoption of the patient-as-partner model serves healthcare well and is flexible enough to accommodate circumstances that dictate modifications. Judging a place as wasteland or homeland is a matter of perspective: presupposed values, knowledge through acquaintance, and comportment. Therefore, contra Martin Drenthen, the value of wilderness is a judgement call, not a conceptual necessity. I show this by first distinguishing wilderness from “wildness,” then culture from civilization, and finally, by situating Nietzsche’s teachings of the will to power in the context of a devalued world-view.Nevertheless, I agree with Drenthen that some understandings of wilderness are more appropriate than others. When (...) wild nature is understood to be “good” in an axiologically transcendent sense, morality and humanness per se are not undermined, and the transcendence of wildness is still sufficiently immanent to avoid the drive to devalue it. Even though such conceptualization can be attained by civilized urbanites, it seems to be optimally actualized in life by non-civilized cultures. This leads to implications that are not easy for us to accept, but deserve our serious consideration nonetheless. (shrink)

Sustainable development is argued to be a linguistic device that has been instrumental in deflecting us from addressing the paradox at the heart of the oxymoron. The relationships between the social, environmental, and economic are explored together with the utility of the I = PAT equation, with reference to the Hardin Taboo, Jevons's, and Easterlin's paradoxes. The use of quality of life (QOL) outcomes in clinical trials is increasing as a number of practical, ethical, methodological, and regulatory reasons for their use have become apparent. It is important, then, that QOL measurements and differences between QOL scores be readily interpretable. We study interpretation in two contexts: when determining QOL and when basing decisions on QOL differences. We consider both clinical situations involving individual patients and research contexts, e.g., randomized clinical trials, involving groups of patients. We note (...) the ethical importance of such understanding: proper interpretation and communication facilitate health care decision making. Communication that facilitates interpretation is of moral significance since better communication can attenuate ethical problems and inform choices. Much of what is communication worthy about QOL assessments is determined by the particular QOL instrument used in the assessment and how it is administered. In practice, these choices will be driven by the purpose of the assessment, but, it is argued, to maximize understanding, we should combine the information garnered from traditional standardized QOL instruments, from individualized QOL assessments, and from a recently proposed dialogic paradigm, where QOL is determined by shared conversation regarding the interpretation of texts. And, while some studies can surely succeed using abbreviated methods of administration (e.g., postal surveys may suffice for certain purposes), we will focus on methods of administration involving interviewer–respondent interaction. We suggest that during the QOL elicitation process, interviewer and respondent should engage in a two-way conversation in order to achieve a shared understanding of the “answers” to QOL “questions” and, finally, to reach a shared interpretation of the individual’s QOL. Abstract. On the naive reading, “radical social constructivism” would be the result of “deconstructing” science. Science would simply be a contingent construction in accordance with social determinants. However, postmodernism does not necessarily abandon fidelity to the objects of thought. Merold Westphal's Derridean philosophy of religion emphasizes that even theology need not eliminate the transcendence of the divine other. By drawing an analogy between natural and supernatural transcendence, I argue that science is similarly called to responsibility in the encounter with that (...) which lies outside its horizon of expectation. Science's rational autonomy is overcome by the heteronomy of realities that precede it. Understanding species as homeostatic property clusters is an example of nonessentialist, postmodern, and scientific realism. Science is still a vehicle for encountering natural alterity, thus decentering the relativism thought to characterize postmodernism. However, natural science must not attempt to place the whole of being at human disposal if it is to fulfill the potential of Westphal's philosophy of religion. (shrink)

Bernard Charbonneau’s The Green Light is a classic text of French environmentalism, first published in 1980 but unavailable in English until now. How has the globalization of technology contributed to the globalization of the war against the Enlightenment liberal humanism of Western civilization—in particular, to the globalization of the war between religion and science—and with what problematic moral, cultural, and spiritual consequences? Liberal-humanist and Heideggerian perspectives on this issue are considered. The latter is chosen because it constitutes an enduring philosophical and political challenge to liberal humanism. For Heidegger, liberal humanism, far from providing a solution to the problems of global technology, is (...) an inherent part of the problem. A case in point is liberal democracy’s use of technology to produce and purvey a humanly degrading mass culture which it also uses technology to export abroad, in effect, to globalize. This chapter revisits some favorite moments in The Good Place to understand Janet's character. Philosophers distinguish between three types of knowledge: competence knowledge, acquaintance knowledge, and propositional knowledge. There are three generally accepted conditions that must be met for someone to have propositional knowledge: belief, truth, and justification. Some contemporary philosophers attempt to specify what kind of justification is required for knowledge. This contemporary debate arises as a result of conflicting interpretations of Plato's classic statement about how one's beliefs must (...) be “tied down” to the truth “by giving an account”. Perceptual knowledge is invariably interpreted via externalism. One need not be able to explain exactly how vision works and how it consequently plays a role in forming perceptual beliefs. In Black Panther, T'Challa and Erik "Killmonger" Stevens experience audiences with their departed fathers. Careful analysis of the second and especially the third Ancestral Plane visits downplays the metaphysical, leading toward a metaphor for better understanding one's place in the world. M'Baku fights gallantly, but T'Challa prevails, and bolsters his worthiness for the throne by sparing M'Baku's life. T'Challa rises from the ground, not in the entombed Hall of Kings, but in what appears to be an African savanna where the (...) sky is rippled in majestic blues and purples, giving off a twilight ambiance. Ingesting it increases one's strength, speed, agility, and stamina. It is akin to Captain America's super soldier serum, which reminds us of that awesome footrace between T'Challa and Steve in Avengers: Infinity War. The Heart Shaped Herb potion, then, helps T'Challa and Killmonger achieve greater focus on each man's past and allows a better perspective on who each one. (shrink)

Attempting to reconcile a robust sense of human freedom with entrenched Church doctrines, Luis de Molina espoused for the first time a complete formulation of the doctrine of divine middle knowledge. However, it immediately sparked vigorous theological and philosophical debate. The debate has been revived, with Robert Adams as the original leading opponent. Adams’s objection is that the doctrine cannot be true since its (alleged) propositional objects lack the requisite metaphysical grounds for their being true. Breaking with many contemporary Molinists, (...) I offer reasons for rejecting popular counterfactual semantics as a means to assess “conditionals of freedom.” I then discuss an alternative way to assess “conditionals of freedom” inspired by Suárez and revived by Richard Gaskin, anticipate an objection to it and argue that it is not as damaging as it first seems. I conclude that a Molinist can respond to Adams-type objections without relying upon popular semantics. (shrink)

We cannot escape Indiana Jones! (Not that we would want to, of course.) Harrison Ford deserves credit for the character's popularity. His ability to subtly play up Indy's foibles while playing down the character's heroism, makes Indiana Jones relatable. Of course, Lucas and the screenwriters are also responsible, as they magnificently depict Indy battling antagonists seeking to possess mystical objects for world domination. But Indy is no mere action hero. He also struggles with unrequited love that lingers for decades, an (...) estrangement from his over-bearing father that lasts just as long, and a life-long obsession with regaining an important object unfairly taken from him. As we know, Indy doesn't always choose wisely, and if the Young Indiana Jones Chronicles are to be trusted, he made many missteps in his youth on the way to becoming the hero we know and love. Indy loses a fight as often as he wins, and when he wins, he doesn't always fight fairly. In fact, he stumbles so often, one might wonder why he persists decade after decade toward his goals. He's not getting any younger. What's the point? And, as he inexplicably trudges on, he-in the four films and various graphic novels-has many alleged encounters with the supernatural. He's not a religious person (at all), so what should he make of those? Should he take the leap of faith and become a believer? While we often see him conducting his highly unconventional fieldwork, spending an unusual amount of time in caves, he cannot completely ignore his "day job" teaching undergraduates and aiding their pursuit of knowledge. But why should archaeologists strive to put artifacts in a museum, or search for "fact," but not "truth" (and who is Dr. Tyree, anyway)? The Indiana Jones character is expressive of the human condition, vividly illuminating our struggles and issues on the big screen. True, we don't have John Williams's orchestra filling us with pride when we manage to do the right thing or play the part of the hero. Still, no one would blame you if you imagined Indy's theme blaring in the background while rising to meet a challenge! (shrink)

Although a reasonably complete description of the lattice of subvarieties of quasi-MV algebras has already been provided, the problem of extending this description to the setting of quasivarieties has so far remained open. Given its apparent logical repercussions, we tackle the issue in the present paper. We especially focus on quasivarieties whose generators either are subalgebras of the standard square quasi-MV algebra S , or can be obtained therefrom (...) through the addition of some fixpoints for the inverse. This article argues that Christianity has the potential to strengthen people’s health when solving the forgiveness dilemma. However – paradoxically – the starting point for the analysis is the presumption that a hasty and imprudent decision to forgive may negatively impact the health of the decision-maker, and that Christianity may contribute to people making unconsidered decisions by prompting them to forgive. In the first part of the analysis, the concept of health and its biblical understanding are discussed. The second part (...) includes both a reflection on forgiveness-related dilemmas and the tension between the decision to forgive and the feeling of regret that may negatively influence health. In this paper, we present an informal introduction to Logical English and illustrate its use to standardise the legal wording of the Automatic Early Termination clauses of International Swaps and Derivatives Association Agreements. LE can be viewed both as an alternative to conventional legal English for expressing legal documents, and as an alternative to conventional computer languages for automating legal documents. LE is a controlled natural language, which is designed both to be computer-executable and to be readable by English speakers (...) without special training. The basic form of LE is syntactic sugar for logic programs, in which all sentences have the same standard form, either as rules of the form conclusion if conditions or as unconditional sentences of the form conclusion. However, LE extends normal logic programming by introducing features that are present in other computer languages and other logics. These features include typed variables signalled by common nouns, and existentially quantified variables in the conclusions of sentences signalled by indefinite articles. Although LE translates naturally into a logic programming language such as Prolog or ASP, it can also serve as a neutral standard, which can be compiled into other lower-level computer languages. We prove that certain natural sequent systems for bi-intuitionistic logic have the analytic cut property. In the process we show that the (global) subformula property implies the (local) analytic cut property, thereby demonstrating their equivalence. Applying a version of Maehara technique modified in several ways, we prove that bi-intuitionistic logic enjoys the classical Craig interpolation property and Maximova variable separation property; its Halldén completeness follows.

In this paper we explore the thesis that the role of argumentation in practical reasoning in general and legal reasoning in particular is to justify the use of defeasible rules to derive a conclusion in preference to the use of other defeasible rules to derive a conflicting conclusion. The defeasibility of rules is expressed by means of non-provability claims as additional conditions of the rules.We outline an abstract approach to defeasible reasoning and argumentation which includes many existing formalisms, including default (...) logic, extended logic programming, non-monotonic modal logic and auto-epistemic logic, as special cases. We show, in particular, that the admissibility semantics for all these formalisms has a natural argumentation-theoretic interpretation and proof procedure, which seem to correspond well with informal argumentation. We prove that all semisimple varieties of FL ew-algebras are discriminator varieties. A characterisation of discriminator and EDPC varieties of FL ew-algebras follows. It matches exactly a natural classification of logics over FL ew proposed by H. Ono.

The paper has two parts preceded by quite comprehensive preliminaries.In the first part it is shown that a subvariety of the variety ${\cal T}$ of all tense algebras is discriminator if and only if it is semisimple. The variety ${\cal T}$ turns out to be the join of an increasing chain of varieties ${\cal D}_n$, which are discriminator varieties. The argument carries over to all finite type varieties of boolean algebras with operators satisfying some term conditions. In the case of (...) tense algebras, the varieties ${\cal D}_n$ can be further characterised by certain natural conditions on Kripke frames.In the second part it is shown that the lattice of subvarieties of ${\cal D}_0$ has two atoms, the lattice of subvarieties of ${\cal D}_1$ has countably many atoms, and for $n>1$, the lattice of subvarieties of ${\cal D}_n$ has continuum atoms. The proof of the second of the above statements involves a rather detailed description of zero-generated simple algebras in ${\cal D}_1$.Almost all the arguments are cast in algebraic form, but both parts begin with an outline describing their contents from the dual point of view of tense logics. In this essay, we defend the design of the Salk polio vaccine trial and try to put some limits on the role schemata should play in designing clinical research studies. Our presentation is structured as a response to de Freitas and Pietrobon who identified the CONSORT statement as a schema that would have, had it existed at the time, ruled out the design of the Salk polio vaccine trial of 1954 in favor of a completely randomized controlled clinical trial. We (...) argue that large-scale public health interventions often require evidence beyond simple efficacy, the limit of what an RCT can provide, and that the design actually adopted for the Salk trial represented a reasonable—albeit imperfect—compromise. This is of more than historical interest in that many contemporary studies are of the scale and scope to require a more pragmatic, rather than explanatory, approach to study design. (shrink)

In this paper we show that a variety of modal algebras of finite type is semisimple iff it is discriminator iff it is both weakly transitive and cyclic. This fact has been claimed already in [4] (based on joint work by the two authors) but the proof was fatally flawed.

The authors describe a logic programming approach to the representation of legislative texts. They consider the potential uses of simple systems which incorporate a single, fixed interpretation of a text. These include assisting in the routine administration of complex areas of the law. The authors also consider the possibility of constructing more complex systems which incorporate several, possibly conflicting interpretations. Such systems are needed for dealing with ambiguity and vagueness in the law. Moreover, they are more suitable than single interpretation (...) systems for helping to test proposed legislation and for helping to give citizens advice. (shrink)

The Disney movie Frozen is the fifth highest grossing movie of all time. In order to better understand this phenomenon and to hypothesize as to why the movie resonated so strongly with audiences, we have interpreted the movie using psychodynamic theory. We pay particular attention to the themes of puberty, adolescence and sibling relationships and discuss examples of ego defenses that are employed by the lead character in relation to these concepts.

We show that the variety of residuated lattices is generated by its finite simple members, improving upon a finite model property result of Okada and Terui. The reasoning is a blend of proof-theoretic and algebraic arguments.
